U.S. Immigration and Customs Enforcement agents in Denver arrested two Honduran men who were released on bond last week after they were charged with attempted murder in a Boulder County road rage case. The Boulder County District Attorney\u2019s Office has criticized the agency for posting incorrect information about the charges the men are facing.<\/p>\n

ICE Denver said in a Wednesday morning X post that its agents had arrested Fabio David Escobar-Munguia and Yerlin Levi Munguia-Hernandez. The agency said in the post that\u00a0Escobar-Munguia would be deported and Munguia-Hernandez would remain in custody while immigration proceedings were pending.<\/p>\n

The two men were arrested June 11 in the Arvada area after police say one of them shot at another vehicle while the two were driving\u00a0on U.S. 36 in Boulder County. No one was injured in the shooting, according to the Boulder County Sheriff\u2019s Office. Both men were charged with two counts of attempted first-degree murder and two counts of attempted first-degree assault, in addition to counts of menacing, illegal discharge of a firearm, and crime-of-violence sentence enhancers, according to online court records.<\/p>\n

ICE Denver falsely claimed in the Tuesday morning X post that the two men had pending charges for murder and assault. The agency posted Thursday morning, stating the post should have said the men faced attempted murder charges.<\/p>\n

The Boulder County District Attorney\u2019s Office criticized the agency for posting false information.<\/p>\n

\u201cIf ICE wants to criticize the judge for the release, ICE should also include accurate information about the charges and accurate information about the bond that was set,\u201d Boulder County District Attorney Michael Dougherty said in a Wednesday evening statement. \u201cThe American people deserve accurate information, and the victims should not be led to believe that they are, in fact, dead. Our office is committed to fighting for public safety and justice \u2013 and doing it with integrity.\u201d<\/p>\n

Each posted a $10,000 cash bond and were released from the Boulder County Jail on June 24, according to online court records. The DA\u2019s Office had asked for a $100,000 secure bond for each man, and a Boulder County District Court judge set bond at $100,000 with the $10,000 cash option.<\/p>\n

Neither man showed up to scheduled court appearances this week, and warrants were issued for their arrests. The DA\u2019s Office has asked for a $200,000 secured bond with no cash option for each man.<\/p>\n

It is unclear when or where ICE arrested the two men. Both are in ICE custody at the Aurora detention facility.<\/p>\n

If a defendant is deported while a case is pending, the case cannot move forward, according to the DA\u2019s Office.<\/p>\n

\u201cWhen that happens, the victims and the community will have neither justice nor closure, and the defendants will not have any consequences whatsoever for their criminal conduct,\u201d Shannon Carbone, a DA\u2019s Office spokesperson, wrote in an email Wednesday afternoon.<\/p>\n
